These Terms govern the use of turbometrics.io as a SaaS offering for website scans, monitoring, alerts, reports and plan-dependent additional features.

turbometrics.io is a service of Dipalino UG (haftungsbeschränkt), Alexander-Puschkin-Platz 1, 01127 Dresden, Germany.
These Terms apply to all contracts on the use of turbometrics.io between us and our users, in the version valid at the time of use or of booking.
turbometrics.io provides features for the technical analysis and monitoring of websites. These may include, in particular, manual scans, scheduled scans, public or private reports, alerts, notifications by e-mail or webhook, PDF reports and plan-dependent limits.
The type and extent of the available features depend on the plan currently active and on the service characteristics published in the application.
Where included in the plan booked, the scope of services also covers the Live Data feature (Real User Monitoring, RUM). This involves embedding a JavaScript snippet on third-party websites which collects anonymised performance data from the end users of those websites and transmits it to turbometrics.io. The type and extent of the Live Data feature depend on the active plan and on the service characteristics published in the application.
Certain features require a user account. You are obliged to provide complete and accurate information when registering and to keep your access credentials confidential.
You are responsible for all activity that takes place under your account, to the extent that you are answerable for it.
Guest scans without a user account may be limited in functionality. Public scans and public reports are designed in principle to be accessible via their respective URL.
Users are responsible for submitting only such content and URLs whose testing and publication is permitted.
There are free and paid plans. The current prices, features and limits are published on turbometrics.io.
Paid plans may be concluded and managed through external payment and billing providers, in particular Stripe. The terms of the payment provider used may additionally apply to billing, payment method, renewal, cancellation and invoice access.
Internal special access, for instance for turbopress.de customers, may be managed differently and is not necessarily subject to ordinary self-service billing.
We endeavour to keep the service highly available. There is, however, no entitlement to uninterrupted availability at all times.
We may develop, adapt or, for good cause, change features, provided that the legitimate interests of users are given reasonable consideration.
turbometrics.io may only be used within the framework of applicable law and these Terms. In particular, any abusive use, any deliberate overloading of the service and any use for testing content for which no authorisation exists are not permitted.
We may temporarily restrict or block access where there are concrete indications of abuse, security risks or serious breaches of contract.
How it works. The Live Data feature allows users to embed a JavaScript snippet on their own websites. This snippet collects performance metrics (in particular LCP, CLS, INP, FCP, TTFB) from the end users of the respective website and transmits them anonymised to turbometrics.io for evaluation and display in the user account.
Responsibility. Users who deploy the Live Data feature are themselves the controller within the meaning of the GDPR for the data collection on their websites. They are obliged in particular:
Pageview limits. The number of pageviews that can be recorded per month depends on the plan booked. Once the limit is exceeded, further pageviews are no longer recorded in that month. Unused allowances expire at the end of the month and are not carried over.
Processing on behalf of the controller. Where turbometrics.io acts as a processor within the meaning of Art. 28 GDPR when processing end users' performance data, we conclude a data processing agreement (DPA) upon request. The current DPA is available at turbometrics.io/dpa.
turbometrics optionally offers AI-generated recommendations for action based on scan results. These recommendations are created automatically by an AI language model and serve solely as non-binding guidance. No guarantee is given as to their completeness, accuracy or suitability for the specific individual case. The recommendations are no substitute for expert advice. turbometrics accepts no liability for measures taken on the basis of these recommendations.
Scan results, scores, alerts, recommendations and reports serve as technical assessment and support. They constitute neither a guarantee, nor legal advice, nor a binding assurance of any particular outcome.
Users remain responsible themselves for the technical or business decisions they take on the basis of the results provided.
We are liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health. In the event of a slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract.
Otherwise liability is excluded to the extent permitted by law. Liability under mandatory statutory provisions remains unaffected.
Paid plans can be cancelled through the respective billing or portal features. The right to extraordinary termination for good cause remains unaffected.
After the contract ends, features may be restricted and access may fall back to free or internal basic tiers, unless agreed otherwise.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions preclude this.
Should individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected.
